Terms of Service

Effective July 22, 2026

These Terms of Service ("Terms") govern access to and use of TorchQuote (the "Service"), operated as TorchQuote ("TorchQuote," "we," "us"). By creating an account, embedding the widget, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What TorchQuote is

TorchQuote is an embeddable instant-quote widget and lead dashboard for metal fabrication and sign shops. A shop ("you," the "Customer") configures its own pricing and embeds the widget on its website. Visitors to that website ("End Users") receive a ballpark price estimate and may submit contact details, which are delivered to the shop as a lead.

2. Estimates are non-binding

Every price shown by the widget or the public calculator is a ballpark range computed from the pricing rules the shop configured. It is not a quote, invoice, or binding offer from TorchQuote or from the shop. Shops are solely responsible for the final price they charge an End User, and for the accuracy of the pricing rules they configure. TorchQuote is not a party to any transaction between a shop and its customers.

3. Accounts and eligibility

You must provide accurate information when creating an account and are responsible for activity that occurs under it. You must be authorized to act on behalf of the business you register. One shop account is provided per subscription.

4. Subscription, billing, and trial

Paid plans are billed monthly through Stripe. New accounts include a 14-day free trial; you won't be charged until the trial ends unless you cancel first. Subscriptions renew automatically each billing period until canceled from the Billing page in your dashboard. Fees are non-refundable except where required by law. We may change pricing on notice; changes apply from your next billing cycle.

5. Lead data and ownership

Leads captured through your embedded widget belong to you. You're responsible for how you use, store, and contact the people in them, including compliance with applicable telemarketing, SMS, and email laws (e.g., TCPA, CAN-SPAM) for any outreach you conduct. If your subscription lapses, new leads may be held rather than delivered until it's reactivated, as described in the dashboard.

6. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, fraudulent, or misleading.
  • Embed the widget on a site you're not authorized to modify.
  • Attempt to disrupt, reverse-engineer, or overload the Service.
  • Use End User contact data for purposes unrelated to the job they inquired about, or share it with third parties without a lawful basis.

7. Intellectual property

TorchQuote and its logo are our trademarks. You retain ownership of your shop branding, pricing configuration, and content you upload (e.g., your logo). We retain ownership of the Service's software, design, and the TorchQuote name.

8. Service availability

We aim to keep the Service reliably available but don't guarantee uninterrupted uptime. The widget is designed to always render and always return an estimate to End Users even if a shop's subscription has lapsed, but we don't guarantee this in every failure scenario.

9. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, TorchQuote is not liable for indirect, incidental, or consequential damages, or for any dispute between a shop and its End Users arising from an estimate. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

10. Termination

You may cancel anytime from the dashboard. We may suspend or terminate accounts that violate these Terms. On termination, your right to use the Service ends; provisions that by their nature should survive (e.g., ownership, liability limits) will survive.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated effective date above. Continued use of the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules.
